CUBA ENVIRONMENTAL FILM FESTIVAL 2016

FILMMAKER RELEASE OF LIABILITY & PERMISSION TO SCREEN

The CUBA ENVIRONMENTAL FILM FESTIVAL 2016 (hereafter, FILM FESTIVAL) is a joint project of Ocean Doctor (USA), the Antonio Núñez Jiménez Foundation for Humanity and Nature (Cuba), the Cuban Institute of Cinematographic Art and Industry (Cuba) and Mundo Latino (Cuba).

The FILM FESTIVAL will be held October 24-31, 2016 at the following venues in Havana, Cuba: Cine Charles Chaplin, Cine 23 y 12, Centro Cultural Cinematográfico Fresa y Chocolate. Immediately following the main events in Havana, several screenings will take place in the community of Cocodrilo on Cuba’s Isle of Youth at the following venue: Centro Cultural de Cocodrilo.

I, the undersigned, acknowledge and agree as follows:

1) I understand and agree that final acceptance of my film into the FILM FESTIVAL may or may not include the screening of my film at all locations of the FILM FESTIVAL; I understand and agree that the FILM FESTIVAL reserves the right to screen or not to screen my film at one or all festival locations; furthermore, I give the FILM FESTIVAL the right to screen my film at any other location in Cuba and date besides the specified locations and dates of the FILM FESTIVAL during 2016;

2) I, the undersigned, have the right or authorization to submit the film to the FILM FESTIVAL and this film production has no pending litigation or disputes regarding any part of the production, distribution or originality.

3) I certify that the motion picture work submitted is the entrant’s original work and does not infringe on any copyrights or any other rights of any third parties;

4) I, the undersigned, hold the FILM FESTIVAL organizers and its partners, sponsors and agents harmless from any damage to submitted media during the process of the FILM FESTIVAL;

5) I, the undersigned, hold the FILM FESTIVAL, its management, organizers, partners, contractors, juries, subsidiaries, agents, sponsors and affiliates harmless from any and all claims of liability resulting from my film entry;

6) I certify that I have full rights to use of the music in the film, for screening and distributing purposes. I certify that I am able to produce the written permission(s) to this at the request of the FILM FESTIVAL;

7) I give permission for the FILM FESTIVAL to use excerpts of my film, trailers and clips of the film, or the whole film, for promotional purposes at no cost and in perpetuity;

8) I give permission for the FILM FESTIVAL to use stills, titles, copy, and information from the film for promotional purposes, online and in any print media or marketing campaigns connected with the FILM FESTIVAL. This includes brochures, printed media, magazines, newspapers and online anywhere in the digital universe;

9) By submitting my film production, I give permission for the FILM FESTIVAL to screen the production at the FILM FESTIVAL more than once and in multiple locations, cities and venues.

10) I own or have authorization to all necessary copyrights and licenses to the submitted motion picture; if requested, I am able to provide model/actor release verification; I will also be able to provide music, product and other copyright licensing verification if requested. As the Submitter/Producer, I agree to take on all copyright liability in regard to the submitted film(s);

11) I give my permission for the FILM FESTIVAL to share my film, any related promotional materials and contact information with FILM FESTIVAL partners unless I specify otherwise;

12) I understand that entry into the FILM FESTIVAL does not guarantee acceptance into the official film program of the FILM FESTIVAL.

13) The FILM FESTIVAL cannot be held responsible or liable for losses or damages resulting from failure to screen entries accepted into the festival program;

14) Entrant agrees to be bound by all terms and conditions of the official rules and guidelines as established herein. If entrant is under 18 years old, the signature of a parent or legal guardian is required.

15) The FILM FESTIVAL reserves the right to extend the film submission deadline for any reasons if needed.

16) PRESENTATION FORMAT: If the film is accepted into the FILM FESTIVAL as an official entry, filmmakers must be able to submit their final film by July 1, 2016 in downloadable HD .mov file format (file format of HD 1920x1080 Apple ProRes 422) or Blu-Ray disk for screening purposes. Failure to provide the official screening copy in this format to the FILM FESTIVAL by July 1, 2016 may result in disqualification.

MUESTRA DE CINE MEDIOAMBIENTAL EN CUBA 2016

ACUERDO DE ACEPTACIÓN DE RIESGO, LIBERACIÓN DE RESPONSABILIDAD

Y DERECHO DE EXHIBICIÓN

La MUESTRA DE CINE MEDIOAMBIENTAL EN CUBA 2016 (Desde ahora llamada MUESTRA) es un proyecto en conjunto entre la Organización Ocean Doctor (Estados Unidos) y la Fundación Antonio Núñez Jiménez de la Naturaleza y el Hombre (Cuba), el Instituto de Arte e Industria Cinematográficos (ICAIC) y Mundo Latino (Cuba).

La MUESTRA se llevara a cabo del 24 al 31 de Octubre, 2016 en los siguientes teatros de la ciudad de la Habana, Cuba: Cine Charles Chaplin, Cine 23 y 12, Centro Cultural Cinematográfico Fresa y Chocolate. Luego de los eventos en la Habana, la MUESTRA trasladará algunos de los documentales a la comunidad de Cocodrilo en la Isla de la Juventud, Cuba, donde algunos documentales serán proyectados en el Centro Cultural de Cocodrilo.

Yo reconozco y estoy de acuerdo con lo siguiente:

(1) Reconozco y estoy de acuerdo que la aceptación final de mi documental en la MUESTRA puede o puede que no incluya la proyección de mi documental en todos los lugares de la MUESTRA; yo reconozco y estoy de acuerdo que la MUESTRA se reserva los derechos de proyección en uno o todos los lugares de la MUESTRA; adicionalmente, le otorgo los derechos de proyección de mi documental a la MUESTRA en cualquier otra localidad y fecha en Cuba , adicionales de las fechas y lugares de la MUESTRA durante el año 2016;

  1. (2) Tengo el derecho y autorización de someter el documental a la MUESTRA y este documental no tiene ninguna litigación pendiente o disputa legal con respecto a la producción, distribución u originalidad;
  2. Certifico que la imagen en movimiento sometida es el entrante original y no infringe ningún derecho de autor o ningún otro derecho de terceros;
  3. Aseguro que no presentaré cargos sobre la MUESTRA, los organizadores, organizaciones de apoyo y agentes con respecto a los medios sometidos durante el proceso de la MUESTRA;
  4. Aseguro que no presentaré cargos sobre la MUESTRA, los organizadores, organizaciones de apoyo, consultores, jurados, subsidiarios, agentes con respecto a reclamos de responsabilidad y liberación de derechos con respecto al documental sometido;
  5. Aseguro que tengo todos los derechos para usar la música del documental, para proyección y distribución;
  6. Le otorgo permiso a la MUESTRA de usar el resumen o cortometraje del documental, o si necesario el documental entero, sin ningún costo;
  7. Le otorgo permiso a la MUESTRA de usar títulos, imágenes, copia e información del documental para promocionar en línea o en imprenta en campañas promocionales de la MUESTRA. Esto incluye imprenta, panfletos, revistas, periódicos, artículos o imágenes en línea en cualquier lugar del universo digital;
  8. Al someter mi documental, le otorgo permiso a la MUESTRA de proyectar mi documental en la MUESTRA, más de una vez y en diferentes localidades, ciudades y lugares de proyección en Cuba;
  9. Es de mi pertenencia o tengo la autorización de todos los derechos de autor y licencias necesarias para someter la imagen en movimiento; en caso de que se solicité, puedo proveer verificaciones de liberación de modelos y actores; también estoy dispuesta a proveer licencia de derechos de autor de música y productos relacionados al documental, en caso de que sea solicitado. Como el productor y agente que somete el documental, estoy de acuerdo en tomar toda la responsabilidad de los derechos de autor con respecto al(a los) documental(es) sometido(s);
  10. Le otorgo permiso a la MUESTRA para compartir mi documental, y todos sus materiales de promoción e información de contacto con otros colegas, a no ser de que se especifique;
  11. Reconozco que al someter mi documental en la MUESTRA no me asegura su incorporación al programa oficial final de la MUESTRA;
  12. La MUESTRA no puede responsabilizarse por la pérdida o daños provenientes de un fallo en la proyección de documentales aceptados en el programa de la MUESTRA;
  13. Entrantes están de acuerdo en respetar todos los términos y condiciones de las reglas oficiales y guías establecidos para la MUESTRA. Si un entrante es menor de 18 años, se requiere de la firma de un padre o representante legal.
  14. La MUESTRA se reserva el derecho de extender la fecha límite de entrega de documentos por cualquier razón, en caso de que sea necesaria.
  15. FORMATO DE PRESENTACIÓN: Si el documental es aceptado en el programa oficial de la MUESTRA, directores deben estar dispuestos a someter el documental en formato final antes del día 1 de Julio del 2016 en un formato que se pueda descargar en definición alta (High Definition - HD) documento de formato .mov (HD 1920x1080 Apple ProRes 422) o en Blue-Ray disk para proyecciones. En caso de que el director falle en proveer la copia para la proyección oficial en este formato a la MUESTRA el día 1 de Julio del 2016 resultara en la descalificación del programa oficial de la MUESTRA.
